eBRAM Signs MOU with Hengdian Film and Television Industry Association and Dongyang Law Society for International Dispute Resolution in the Film and Television Industry

Creating a New Corridor for International Dispute Resolution in the Industry and Jointly Promoting the Healthy and Orderly Development of the Film and Television Industry
(Hong Kong, November 5, 2024) eBRAM International Online Arbitration and Mediation Center (“eBRAM”), an independent non-profit organization supported by the Government of the Hong Kong Special Administrative Region (“HKSAR”), recently signed a “Memorandum of Understanding (“MOU”) on International Dispute Resolution in the Film and Television Industry” with Hengdian Film and Television Industry Association and Dongyang Law Society in Zhejiang Province. This collaboration aims to provide efficient, professional, and convenient international dispute resolution solutions for the global film and television industry.
The signing ceremony took place at the 2024 Hengdian Film and Culture Industrial Conference. Mr. Horace Cheung, Deputy Secretary for Justice of the HKSAR, delivered a video address, congratulating the parties. He stated, “This collaboration not only opens a new channel for international dispute resolution in the domestic film and television industry but also promotes in-depth exchanges and collaboration between Hong Kong and the Mainland. Hong Kong, as one of the most popular arbitration venues globally, will continue to play its role as a ‘super-connector’ and provide strong support for this collaboration.”
Mr. Cheung reiterated, “eBRAM, supported by the Government of the HKSAR, is an independent non-profit organization combining law and technology. This collaboration with the Hengdian Film and Television Industry Association will significantly promote the development of the film and television culture and legal circles. The government will continue to support eBRAM in enhancing cross-border collaboration and providing high-quality, cost-effective, and efficient international dispute resolution solutions for the national film and television industry.”
Leading with Technology and Innovating Dispute Resolution Mechanisms
As the only platform in Hong Kong recognized by the “APEC Collaborative Framework for Online Dispute Resolution of Cross-Border Business-to-Business Disputes”, eBRAM leverages technologies such as blockchain and artificial intelligence (“AI”) to enhance arbitration and mediation services. This collaboration will further promote technology application in dispute resolution, offering the film and television industry more intelligent and efficient solutions.
At the signing ceremony, Dr. Thomas So, Chairman of eBRAM, Mr. Zhou Zhengyue, Executive Vice President of Dongyang Law Society, and Mr. Huang Leiguang, Legal Representative and Secretary-General of Hengdian Film and Television Industry Association, signed the MOU in the presence of Ms. Cathy Szeto, Senior Government Counsel and Representative of the Department of Justice of Hong Kong, Mr. Xu Jie, Full-time Vice Chairman of Zhejiang Law Society, Mr. Sun Daquan, Full-time Vice President of Jinhua Law Society, and Mr. Xu Tianfu, Executive Vice President of Hengdian Film and Television Industry Association.
Dr. Thomas So stated, “We are honored to reach this consensus with our partners. This partnership will provide strong legal support for the industry’s healthy development and inject new vitality into its harmony and stability.”
In the future, the parties will establish China’s first international arbitration mechanism dedicated to the first domestic center dedicated to international dispute resolution in the film and television industry and promote the adoption of eBRAM’s dispute resolution clauses, fostering sustainable development.
Promoting the healthy development of the film and television industry In line with national strategy
On October 9, 2024, HKSAR and the Ministry of Commerce signed The Second Agreement Concerning Amendments to the Mainland & Hong Kong Closer Economic Partnership Arrangement (CEPA) Agreement on Trade in Services. According to the agreement, Hong Kong service suppliers can invest in the Mainland’s film production industry. With the approval of the Mainland’s competent authorities to establish distribution companies, Hong Kong service suppliers can engage in distribution for Hong Kong films introduced in the form of buyouts.
Furthermore, the film and television Hong Kong and the mainland can leverage the exceptional resource integration capabilities of the eBRAM Deal-Making Portal (“DMP”), along with the unique advantages conferred by the Mainland and Hong Kong Closer Economic Partnership Arrangement, to actively explore the international market and pursue broader development opportunities. By DMP, the mainland film and television industry can enhance information sharing, efficiently connect with international projects, and cross-border collaboration. Simultaneously, it can strengthen its collaboration with top-tier global production teams, prioritize content high-quality production, aiming to establish a favourable brand image on the international stage, achieve broader international influence, and enhance market recognition.
